The Commission has received applications from EN Project Company One Pty Ltd for an electricity generation and distribution licence in accordance with the Electricity Act 1996 (Electricity Act).

The applicant is seeking to operate solar PV generation units and embedded networks at the Murray Bridge Marketplace (950 kW) and the Mt Gambier Marketplace (600 kW).

In assessing such applications, the Commission considers the applications against the relevant licensing provisions set out in the Electricity Act. It will also have regard to its primary objective under the Essential Services Commission Act 2002, being the protection of the long term interests of South Australian consumers with respect to the price, quality and reliability of essential services and other factors as they apply to the Commission's role as an economic regulator of the South Australian electricity industry.

The Commission may only issue a licence if it is satisfied the applicant is a suitable person to hold the licence. In making its assessment the Commission considers (among other things):
the standard of honesty and integrity shown by the applicant and its directors and major shareholders in previous commercial and regulatory dealings
the financial, technical and human resources available to the applicant, and
the quality of the generated electricity for the relevant transmission or distribution network.

In making its assessment, the Commission consults with the Australian Energy Market Operator and the Office of The Technical Regulator, which have separate stand-alone roles in the electricity industry. Matters related to health and environment protection are regulated under separate legislative frameworks and can only be considered by the Commission in context of the above-mentioned criteria.

The applications submitted by EN Project Company One Pty Ltd are subject to a public consultation period closing on 30 March 2018. Interested parties wishing to make a submission on these licence applications should prepare a submission that addresses the criteria noted above.
