The Commission has received an application for the transfer of an electricity distribution, generation and retail licence held by Cowell Electric Supply Pty Ltd to A.C.N. 626 950 829 Pty Ltd. The application form has been submitted in accordance with section 28 of the Electricity Act 1996 (Electricity Act).
Cowell Electric Supply Pty Ltd current operates generation plants and distribution networks, as well as retails electricity, in various locations in regional and remote areas of South Australia. A.C.N. 626 950 829 Pty Ltd is seeking to take over all of Cowell Electric Supply Pty Ltd’s licensed activities.
In assessing an application, the Commission considers the application against the relevant licensing provisions set out in the Electricity Act. It will also have regard to its primary objective under the Essential Services Commission Act 2002, being the protection of the long-term interests of South Australian consumers with respect to the price, quality and reliability of essential services and other factors as they apply to the Commission's role as an economic regulator of the South Australian electricity industry.
The Commission may only issue a licence if it is satisfied the applicant is a suitable person to hold the licence. In making its assessment the Commission considers (among other things):
- the standard of honesty and integrity shown by the applicant and its directors and major shareholders in previous commercial and regulatory dealings, and
- the financial, technical and human resources available to the applicant.
In making its assessment, the Commission consults with the Office of The Technical Regulator (OTR) which has separate stand-alone roles in the electricity industry. Matters related to health and environment protection are regulated under separate legislative frameworks and can only be considered by the Commission in context of the above mentioned criteria.
The application submitted by A.C.N. 626 950 829 Pty Ltd is subject to a public consultation period closing on 27 August 2018. Interested parties wishing to make a submission on this licence application should prepare a submission which addresses the criteria noted above.
