Overview

In 2019 the Commission undertook compliance action against EnergyAustralia in relation to its failure to achieve its electricity energy efficiency priority group target under the REES.

The Commission determined to issue a statutory Warning Notice under the Electricity Act 1996 to EnergyAustralia requiring it to:

  • publicly advise its customers of its contravention of the Electricity (General) Regulations 2012 by failing to achieve a REES target, and
  • establish and implement an engagement plan for priority group customers so it would focus on the provision of energy efficiency activities to this customer group in the 2019 REES reporting year.

In accordance with the Electricity (General) Regulations 2012 and Gas Regulations 2012, EnergyAustralia Pty Ltd (EnergyAustralia) had energy efficiency target and energy audit target obligations for the 2018 REES year in respect of both its electricity and gas retail authorisations.

Based on the data lodged by EnergyAustralia during the 2018 REES reporting period (and applying any previous credits), the Commission determined that EnergyAustralia failed to achieve one of its six targets, being the electricity energy efficiency priority group target. 

Pursuant to regulation 32(2) of the Electricity Regulations, the Commission determined to adjust EnergyAustralia’s 2019 REES target by adding its electricity priority group energy efficiency shortfall amount its 2019 REES target (as required by regulation 27(3) of the Electricity Regulations).

Further, the Commission determine to issue a statutory Warning Notice under the Electricity Act 1996 to EnergyAustralia requiring it to:

  • publicly advise its customers of its contravention of the Electricity (General) Regulations 2012 by failing to achieve a REES target, and 
  • establish and implement an engagement plan for priority group customers so it would focus on the provision of energy efficiency activities to this customer group in the 2019 REES reporting year.

Pursuant to section 63B of the Electricity Act 1996, EnergyAustralia provided a statutory written Assurance to the Commission, which stated that:

  • EnergyAustralia would meet its 2019 REES targets, including the shortfall amount added to its electricity priority group energy efficiency target, and
  • EnergyAustralia would report monthly to the Commission, for the balance of 2019, on its progress towards its adjusted 2019 REES electricity priority group energy efficiency target.
