Overview

The Commission is undertaking a review into the effectiveness of the Retailer Energy Productivity Scheme (REPS) Code.  

The REPS Code establishes requirements and procedures in relation to the conduct and operations of obliged energy retailers in their satisfaction of their obligations under the REPS.  This includes:

  • achievement of annual energy productivity targets
  • record-keeping and reporting obligations, and
  • compliance and audit obligations.

The Commission has published a Final Decision on its review of the REPS Code. The Final Decision amends some aspects of the Code   to ensure it continues to effectively protect the long-term interests of consumers for the second REPS period of 2026-2030. 

Amendments include:

  • ensuring consumers are provided with information about their rights and any deadlines for undertaking activities under the scheme
  • requiring retailers to provide information about the scheme and how customers can access it on their website
  • only allowing deposits to be taken if the activity will be undertaken in that calendar year or, in the case of activities undertaken in November or December, within 30 business days of receipt of the deposit, at the price quoted
  • requiring retailers to ensure that any directly contracted parties who deliver REPS activities on their behalf are members of the Energy and Water Ombudsman of South Australia
  • reducing the frequency of compliance plans from annual to once for the REPS period, unless amended, and
  • requiring that a minimum of 5 percent of REPS activities are audited by retailers for the purposes of checking compliance with the REPS regulatory requirements.

A revised version of the Code is published alongside the Final Decision. The revised Code will apply from 1 January 2026.
