Overview

In February 2006, the Northern Territory and South Australian Ministers responsible for the AustralAsia Railway (Third Party Access) Act 1999, (which contains the AustralAsia Railway (Third Party Access) Code) requested that the Commission conduct the Code review as required under clause 50 of the Code. The review looked at the effectiveness of the Code in facilitating access by users to the AustralAsia (Tarcoola-Darwin) railway. Recommendations arising from the review were to have regard to the requirements for certification of a state-based access regime arising under Part IIIA of the Trade Practices Act. The Code is a certified regime. The Commission has completed its work on the Ministerial Review of the Code. The Commission forwarded its final report to the SA/NT Ministers in early June.

The Commission has completed its work on the Ministerial Review of the Code. The Commission forwarded its final report to the SA/NT Ministers in early June. The Ministers' report on the outcome of the review, including the Commission's final report, was laid before the respective Parliaments in each jurisdiction on 29 August 2006. The Ministers have concluded that no changes to the AustralAsia (Third Party Access) Code are currently warranted.
