The Commission has received an applications from Enwave Tonsley Pty Ltd for a gas distribution licence. The applicant is seeking to operate a gas distribution network at the Tonsley Innovation District.

The Commission has received an application from Enwave Tonsley Pty Ltd for an gas distribution licence in accordance with the Gas Act 1996 (Gas Act). The applicant is seeking to operate a gas distribution network located at the Tonsley Innovation District.
In assessing a gas distribution application, the Commission considers the application against the relevant licensing provisions set out in the Gas Act. It will also have regard to its primary objective under the Essential Services Commission Act 2002, being the protection of the long-term interests of South Australian consumers with respect to the price, quality and reliability of essential services and other factors as they apply to the Commission's role as an economic regulator of the South Australian gas industry.
The Commission may only issue a licence if it is satisfied the applicant is a suitable person to hold the licence. In making its assessment the Commission considers (among other things):
- the standard of honesty and integrity shown by the applicant and its directors and major shareholders in previous commercial and regulatory dealings, and
- the financial, technical and human resources available to the applicant.
In making its assessment, the Commission consults with the Office of the Technical Regulator, which has a separate stand-alone role in the gas industry. Matters related to health and environment protection are regulated under separate legislative frameworks and can only be considered by the Commission in context of the above mentioned criteria.
The application submitted by Enwave Tonsley Pty Ltd is subject to a public consultation period closing on 31 October 2018. Interested parties wishing to make a submission on this licence application should prepare a submission which addresses the criteria noted above.
