The Commission has received an application for the transfer of an electricity generation licence held by the Minister of Energy and Mining to Cowell Electric Supply Pty Ltd. The application form has been submitted in accordance with section 28 of the Electricity Act 1996 (Electricity Act).

The Minister of Energy and Mining currently operates generation plant for the communities of Yalata and Oak Valley in regional South Australia. Cowell Electric Supply Pty Ltd is seeking to take over the Minister of Energy and Mining’s licensed activities on 1 July 2020.

In assessing a variation application, the Commission considers the relevant licensing provisions set out in the Electricity Act. It will also have regard to its primary objective under the Essential Services Commission Act 2002, being the protection of the long-term interests of South Australian consumers with respect to the price, quality and reliability of essential services, and other factors as they apply to the Commission's role as an economic regulator of the South Australian electricity industry. 

In making its assessment, the Commission considers technical advice from the Office of the Technical Regulator. Matters related to health and environment protection are regulated under separate legislative frameworks.

Cowell Electric Supply Pty Ltd application is subject to a public consultation period closing on 26 May 2020. The Commission welcomes submissions on any matters relevant to the application. 

 

Background

On 18 July 2018, the Commission varied the electricity distribution licence held by Cowell Electric Supply Pty Ltd to remove the distribution network at Woomera.

The Commission assessed Cowell Electric Supply Pty Ltd’s application for a variation to its electricity distribution licence against the relevant provisions of the Electricity Act 1996 and the Essential Services Commission Act 2002 and determined that all relevant criteria under those Acts have been satisfied. 

On 8 March 2016, Cowell Electric Supply Pty Ltd (Cowell Electric) applied to the Commission for an electricity generation licence and variations to its retail and distribution licences.

The Commission undertook a round of public consultation in relation to the application and received no submissions from stakeholders.

The Commission has assessed the application against the relevant provisions of the Electricity Act 1996 and the Essential Services Commission Act 2002 (as they apply to the Commission's role as an economic regulator of the South Australian electricity industry) and determined that all relevant criteria have been satisfied.

The electricity generation licence and variations to its retail and distribution licences were issued to Cowell Electric on 31 March 2016.
