Variation to Water retail licence – Cape Jaffa Anchorage Essential Services Pty Ltd

The Commission has varied Cape Jaffa Anchorage Essential Services Pty Ltd’s (CJAES) water retail licence, from authorising the sale and supply of drinking water to non-drinking water, to residential and non-residential customers within the Cape Jaffa Anchorage Essential Services boundary.

The Commission undertook a round of public consultation in relation to the application and received 33 submissions.

The Commission has assessed the application against the relevant provisions of the Water Industry Act 2012 and the Essential Services Commission Act 2002

CJAES’ registration under the Safe Drinking Water Act 2011 as a drinking water entity, has been cancelled. CJAES can no longer legally provide drinking water from its existing bore, due to public health concerns raised by SA Health in relation to naturally increasing fluoride levels. 

As a consequence of being deregistered as a drinking water entity, CAJES is restricted to providing non-drinking water only and the water retail licence of CJAES must be varied to reflect the status of CJAES as a non-drinking water entity.

CJAES does not propose a change to the scale of its operations, and will continue to provide non-drinking water services to its customers within the Cape Jaffa Anchorage Essential Services boundary. The Commission is satisfied that CJAES can continue to provide non-drinking water and sewerage services to its customers.

CJAES currently meets its obligations under its licence for drinking water and sewerage services. The variation of the licence to non-drinking water and sewerage services is due to a natural change in the bore water being sourced and is not due to the operations or infrastructure of the applicant.

The Commission has also taken action to ensure that all future customer communications must reflect CJAES’ status as a non-drinking water entity.
