Overview

The Commission has received an application from AGL SA Generation Pty Ltd for an exemption from the requirement to hold an electricity distribution licence under the Electricity Act 1996. AGL SA Generation Pty Ltd  is seeking to provide electricity, directly from its generation plant at Torrens Island, to one on-site customer via a private distribution network.

On 10 December 2015, the Commission received an application from AGL SA Generation Pty Ltd (AGL SA) for an exemption from the requirement to hold an electricity distribution licence under the Electricity Act 1996 (Electricity Act). AGL SA sought to provide electricity, directly from its generation plant at Torrens Island, to one on-site customer via a private distribution network.

The Commission undertook a round of public consultation in relation to the application and received no submissions from stakeholders.

The Commission assessed the application against the relevant provisions of the Electricity Act and the Essential Services Commission Act 2002 (as they apply to the Commission's role as an economic regulator of the South Australian electricity industry) and determined that that all relevant criteria have been satisfied and an exemption is appropriate.

The electricity generation exemption was issued to AGL SA on 29 April 2016.
