  • potable water to residential customers in Fitzgerald Bay.

The Commission has received an application from The Corporation of the City of Whyalla for a water retail licence (licence) in accordance with the Water Industry Act 2012 (Act). The Corporation of the City of Whyalla is seeking a licence for the sale and supply of:

  • non-potable water to non-residential customers for irrigation purposes, and
  • potable water to residential customers in Fitzgerald Bay.

Before approving a licence application, the Act requires the Commission to be satisfied of a number of criteria. These include:

  • the suitability of the applicant (which includes a consideration of the standard of honesty and integrity shown by the applicant and its directors and major shareholders in previous commercial and regulatory dealings)
  • the ability of the applicant to meet reasonably foreseeable obligations under contracts for the sale and supply of water at the relevant location
  • the appropriateness of the water infrastructure proposed to be used in connection with the service, and
  • the financial, technical and organisational capacity of the applicant to provide the service safely and to appropriate standards.

It will also have regard to its primary objective under the Essential Services Commission Act 2002, being the protection of the long term interests of South Australian consumers with respect to the price, quality and reliability of essential services and other factors as they apply to the Commission's role as the economic regulator of the South Australian water service industry.

In assessing an applicant against the above criteria, the Commission consults with other regulators, including the Technical Regulator, SA Health and the Environmental Protection Authority, which have regulatory roles in the water industry.  

The application submitted by The Corporation of the City of Whyalla is subject to a public consultation period closing on 21 July 2016. Interested parties wishing to make a submission on this licence application should prepare a submission which addresses the criteria noted above.
