Overview

Under the Electricity (General) Regulations 2012 and Gas Regulations 2012 (Regulations), the Commission has such functions and powers as are necessary and expedient to give effect to REES. The exercise of those powers and functions requires the Commission to have regard to the intent, purpose and integrity of the scheme as established under the Regulations.

The Regulations provide that the Commission apportion the Minister for Mineral Resources and Energy’s (Minister’s) overall Retailer Energy Efficiency Scheme (REES) targets in accordance with requirements specified by the Minister.

Retailers reported data relating to the 2013-14 financial year to the Commission in January 2015. The Commission issued 2015 REES targets in April 2015. Momentum Energy (Momentum) subsequently notified the Commission of a significant omission in the data it reported to the Commission which affected the apportionment of the 2015 Energy Efficiency Targets (targets).

In this instance, having regard to the legal operation of the statutory regime, the nature and extent of Momentum’s omission and the feedback provided to it, the Commission has decided that it is appropriate to reapportion 2015 targets for all obliged retailers, so as to give effect to the targets set by the Minister for 2015.
